Regulation (EU) 2019/1150 protects businesses selling to European CONSUMERS through an online platform (marketplace, comparison site, app store).

Who is affected

  • Businesses established in the European Union that sell to European consumers through an online platform (marketplace, comparison site, app store) or that appear in a search engine (Article 1(2)).
  • The platforms that provide this service to them, wherever they are established, in Europe or in Asia (Article 1(2)).
  • Important: a seller based in China, Thailand or Vietnam, with no establishment in the EU, is not protected by this regulation. The text covers businesses "whose place of establishment or residence is in the Union". If the seller opens a subsidiary or an establishment in Europe, that entity is protected.
  • Purely business-to-business platforms (with no sales to consumers) are not covered.

What the platform must give you

  1. Clear terms, available at all times, stating the reasons for which it may suspend or close your account (Article 3(1)).
  2. At least 15 days' notice before changing its terms, sent on a durable medium (for example an e-mail); longer if you need to adapt your shop (Article 3(2)).
  3. Written reasons if it restricts or suspends your account, at the latest when the measure takes effect; 30 days in advance if it closes your account completely (Article 4(1) and (2)). You can give your side of the story (Article 4(3)).
  4. How offers are ranked, including whether paying moves you up (Article 5).
  5. A free complaint-handling system and at least two mediators named in its terms (Articles 11 and 12). Platforms that are small enterprises (within the meaning of European Recommendation 2003/361/EC) are exempt (Article 11(5) and Article 12(7)).

What to do

  1. Keep a copy of the platform's terms and of every e-mail announcing a change.
  2. If you are suspended without written reasons: ask for them in writing, citing Article 4 of Regulation (EU) 2019/1150.

Dates

  • Applicable since 12 July 2020 (Article 19).
